In order to install a commercial cell spyware app on a phone, you MUST have physical access to the phone. This is because these apps are downloaded using the phone's web browser and must be set up/ configured using the phone that you installed the app on. Once the app is installed, you no longer will need any more access unless to the phone. In fact, some of the newer spy apps have remote uninstall and ways to change the configuration without having to touch the phone.

Bottom line, keep your phone with you at all time, password protect your phone, and never let it out of your sight -- then you won't have anything to worry about.

Please note: The reason why I emphasized 'commercial cell spyware app' is because there are some rogue malware and other spy apps that can be installed remotely using MMS messages or disguised as a legitimate app, but these are what many people will consider a virus and are obviously cannot be purchased online.
